Legans advokátní kancelář s.r.o. is an obliged entity pursuant to Act No. 253/2008 Coll., on Certain Measures Against the Legalization of Proceeds from Crime and Terrorist Financing, as amended. Under this Act, the company is required to implement measures according to this Act and other regulations, including, among others, the identification and verification of the client. For this purpose, the company is obliged to collect and retain the client's personal data and make copies of the documents from which this data was verified..

The Personal Data Controller is Legans advokátní kancelář s.r.o., ID No. 07972172, with its registered office at Revoluční 1003/3, Staré Město, 110 00 Prague 1, registered in the Commercial Register maintained by the Municipal Court in Prague under File No. C 310802. The Company, as the controller of personal data provided to it on the basis of a contract with a client, undertakes to process such personal data in accordance with legal regulations, primarily Act No. 85/1996 Coll. (the Legal Profession Act), Act No. 110/2019 Coll., on Personal Data Processing, and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.
Personal Data Processing Period:
Personal data will be processed for the duration of the validity of the aforementioned contract, and upon its termination, it will be handled in accordance with applicable legislation, particularly Act No. 85/1996 Coll. (the Legal Profession Act), Act No. 499/2004 Coll. (on Archives and File Service and on the Amendment of Certain Acts), Act No. 110/2019 Coll. (on Personal Data Processing), and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR Regulation).
Purpose of Processing:
Provision of legal services pursuant to the contract concluded with the client.
Recipients of Personal Data:
Public authorities (e.g., courts, administrative bodies), information system maintenance providers, and other recipients according to the client's needs and instructions.
Client Rights:
The right of access to personal data means that the client has the right to obtain information from the controller – Legans advokátní kancelář s.r.o. – regarding whether it processes their personal data, and if so, what data is involved and how it is processed. The client also has the right to have the controller correct inaccurate personal data concerning them without undue delay upon request. The client has the right to complete incomplete personal data at any time. The right to erasure of personal data represents the obligation of the controller to dispose of personal data processed about the client if certain conditions are met and the client requests it. The client has the right to have the controller restrict the processing of their personal data in certain cases. The client has the right to object at any time to processing based on the legitimate interests of the controller or a third party, or which is necessary for the performance of a task carried out in the public interest or in the exercise of official authority. The right to data portability gives the client the option to obtain personal data provided to the controller in a structured, commonly used, and machine-readable format. This data may subsequently be transferred to another controller, or if technically feasible, the client may request that the controllers transfer it between themselves. The right to withdraw consent to personal data processing at any time does not apply, as the client's personal data is processed for the purpose of fulfilling the contract concluded with the client, not based on consent to processing. In the event that the client is dissatisfied in any way with the processing of their personal data by the controller, they may file a complaint directly with the controller or contact the Office for Personal Data Protection.
