Pr\u00e1vn\u00ed odbornost? Jejich dobr\u00e1 znalost spole\u010dnosti? Samoz\u0159ejm\u011b, v\u0161echny tyto faktory hraj\u00ed d\u016fle\u017eitou roli. Co v\u0161ak skute\u010dn\u011b odli\u0161uje efektivn\u00ed&nbsp; intern\u00ed pr\u00e1vn\u00ed t\u00fdm od b\u011b\u017en\u00fdch pr\u00e1vn\u00edk\u016f, je jeho schopnost \u0159e\u0161it konkr\u00e9tn\u00ed pr\u00e1vn\u00ed probl\u00e9my spole\u010dnosti pomoc\u00ed dob\u0159e nastaven\u00fdch a \u00fa\u010dinn\u00fdch postup\u016f. Tyto procesy jsou z\u00e1kladem pro hladk\u00e9 fungov\u00e1n\u00ed pr\u00e1vn\u00ed agendy, zlep\u0161uj\u00ed komunikaci a p\u0159isp\u00edvaj\u00ed k dlouhodob\u00e9mu rozvoji organizace.<\/p>\n\n\n\n<p>Jak uv\u00e1d\u011bj\u00ed odborn\u00edci, \u201eorganizace maj\u00ed schopnosti, kter\u00e9 existuj\u00ed nez\u00e1visle na schopnostech lid\u00ed, kte\u0159\u00ed v nich pracuj\u00ed;\u201c tyto schopnosti jsou p\u0159itom v\u00fdsledkem pr\u00e1v\u011b proces\u016f zaveden\u00fdch v t\u011bchto organizac\u00edch[1]. Nen\u00ed to nov\u00e1 my\u0161lenka: Jako p\u0159\u00edklad lze uv\u00e9st \u0159\u00edzen\u00ed spole\u010dnosti Toyota, kter\u00e9 je zalo\u017eeno na p\u0159edstav\u011b, \u017ee chyby jsou v\u011bt\u0161inou syst\u00e9mov\u00e9ho p\u016fvodu; Toyota sama proto vyvinula inovativn\u00ed postupy umo\u017e\u0148uj\u00edc\u00ed zam\u011bstnanc\u016fm snadno hl\u00e1sit probl\u00e9my p\u0159\u00edmo na pracovi\u0161ti[2]. V kontextu pr\u00e1vn\u00edho managementu je v\u00fdznam efektivn\u011b nastaven\u00fdch n\u00e1stroj\u016f a postup\u016f z\u0159ejm\u00fd: \u201es t\u011bmi spr\u00e1vn\u00fdmi n\u00e1stroji zalo\u017een\u00fdmi na procesech m\u016f\u017ee i nezku\u0161en\u00fd pr\u00e1vn\u00edk odv\u00e9st nadpr\u016fm\u011brnou pr\u00e1vn\u00ed pr\u00e1ci\u201c[3].<\/p>\n\n\n\n<p>Intern\u00ed pr\u00e1vn\u00ed kancel\u00e1\u0159e dnes pracuj\u00ed se \u0161irokou \u0161k\u00e1lou r\u016fzn\u00fdch mana\u017eersk\u00fdch metod a n\u00e1stroj\u016f, jako jsou Six Sigma, anal\u00fdza SWOT nebo jin\u00e9 standardn\u00ed opera\u010dn\u00ed postupy[4]. Zvl\u00e1\u0161tn\u00ed pozornost si pak zaslou\u017e\u00ed metodika DMAIC, kter\u00e1 propojuje jednotliv\u00e9 z\u00e1kladn\u00ed kroky proces\u016f \u0159e\u0161en\u00ed probl\u00e9m\u016f do ucelen\u00e9ho r\u00e1mce[5]. Akronym \u201eD, M, A, I. C\u201c p\u0159edstavuje zkratku ozna\u010den\u00ed jednotliv\u00fdch etap cyklu, kter\u00e9 jsou na sebe postupn\u011b nav\u00e1z\u00e1ny a logicky vymezuj\u00ed, na jak\u00e9 \u010dinnosti jsou zam\u011b\u0159eny. Zkratka \u201eD, M, A\u201c znamen\u00e1&nbsp;: Definovat, M\u011b\u0159it a Analyzovat (define, measure, analyze), a tyto kroky ve sv\u00e9 podstat\u011b p\u0159edstavuj\u00ed identifikaci probl\u00e9mu a jeho p\u0159\u00ed\u010din jako p\u0159edpokladu pro poskytov\u00e1n\u00ed adekv\u00e1tn\u00edch \u0159e\u0161en\u00ed[6]. P\u00edsmeno \u201eI\u201c znamen\u00e1 Zlep\u0161it (improve) a jeho c\u00edlem je odstran\u011bn\u00ed faktor\u016f identifikovan\u00fdch p\u0159edchoz\u00edm postupem, kter\u00e9 nep\u0159in\u00e1\u0161ej\u00ed hodnotu; Posledn\u00ed p\u00edsmeno \u201eC\u201c pak znamen\u00e1 kontrolovat, resp. \u0159\u00eddit (control) a jeho c\u00edlem je integrace pricncip\u016f zlep\u0161ov\u00e1n\u00ed do ka\u017edodenn\u00ed praxe.<\/p>\n\n\n\n<p>Vedle proces\u016f zam\u011b\u0159en\u00fdch na \u0159e\u0161en\u00ed probl\u00e9m\u016f je pro plynul\u00e9 fungov\u00e1n\u00ed pr\u00e1vn\u00edch slu\u017eeb kl\u00ed\u010dov\u00e9 tak\u00e9 vhodn\u00e9 nastaven\u00ed komunika\u010dn\u00edch kan\u00e1l\u016f. Intern\u00ed komunikace nap\u0159\u00ed\u010d organizac\u00ed je z\u00e1sadn\u00ed nejen pro samotnou identifikaci rizikov\u00fdch sc\u00e9n\u00e1\u0159\u016f, p\u00edsemn\u00fdch pl\u00e1n\u016f a kontroln\u00edch seznam\u016f jejich \u0159e\u0161en\u00ed, jako\u017e i pro jejich implementaci, ale tak\u00e9 pro zvy\u0161ov\u00e1n\u00ed pov\u011bdom\u00ed ostatn\u00edch zam\u011bstnanc\u016f[7]. Rovn\u011b\u017e extern\u00ed komunikace, nap\u0159. s obchodn\u00edmi partnery \u010di klienty, p\u0159edstavuje ned\u00edlnou sou\u010d\u00e1st celkov\u00e9ho \u0159e\u0161en\u00ed, a mus\u00ed proto proj\u00edt kontroln\u00edmi postupy, kter\u00e9 pr\u00e1vn\u00edmu t\u00fdmu umo\u017en\u00ed odhalit p\u0159\u00edpadn\u00e9 nedostatky[8].<\/p>\n\n\n\n<p>Nalezen\u00ed optim\u00e1ln\u00edho syst\u00e9mu \u0159\u00edzen\u00ed pr\u00e1vn\u00edch proces\u016f p\u0159edstavuje v\u00fdzvu. Realizace skute\u010dn\u011b \u017eivotaschopn\u00e9ho ak\u010dn\u00edho pl\u00e1nu p\u0159itom \u010dasto nen\u00ed jednor\u00e1zovou z\u00e1le\u017eitost\u00ed, naopak se jedn\u00e1 o iterativn\u00ed proces, kter\u00fd vy\u017eaduje pr\u016fb\u011b\u017en\u00e9 u\u010den\u00ed a p\u0159izp\u016fsobov\u00e1n\u00ed uvnit\u0159 organizace i mezi kl\u00ed\u010dov\u00fdmi extern\u00edmi partnery\u201c[9]. P\u0159i n\u00e1vrhu syst\u00e9mu \u0159\u00edzen\u00ed pr\u00e1vn\u00edch proces\u016f je proto v\u017edy kl\u00ed\u010dov\u00e9 za\u010d\u00edt s v\u011bdom\u00edm jeho v\u00fdznamu. Jeho n\u00e1vrh by m\u011bl odpov\u00eddat specifick\u00fdm pot\u0159eb\u00e1m organizace a vytv\u00e1\u0159et pevn\u00fd r\u00e1mec pro \u0159\u00edzen\u00ed pr\u00e1vn\u00edch z\u00e1le\u017eitost\u00ed a podporu rozvoje spole\u010dnosti.<\/p>\n\n\n\n<p>Efektivn\u00ed \u0159\u00edzen\u00ed pr\u00e1vn\u00edch proces\u016f nen\u00ed jen o \u0159e\u0161en\u00ed probl\u00e9m\u016f \u2013 jde o strategick\u00fd p\u0159\u00edstup, kter\u00fd dok\u00e1\u017ee posunout va\u0161e podnik\u00e1n\u00ed na novou \u00farove\u0148 a z\u00e1rove\u0148 podpo\u0159it jeho dlouhodob\u00fd r\u016fst. Jen ty nej\u00fasp\u011b\u0161n\u011bj\u0161\u00ed organizace dok\u00e1\u017eou pr\u00e1vn\u00ed v\u00fdzvy nejen zvl\u00e1dat, ale i p\u0159edv\u00eddat. Jak?
